TAKE NOTICE that Third Energy UK Gas Limited (Company Number 01421481) of Knapton Generating Station, East Knapton, Malton North Yorkshire, Y017 8JF ("Third Energy") has applied to the Secretary of State for Business, Energy and Industrial Strategy ("the appropriate authority") to vary the Section 36 consent to construct and operate an open cycle gas turbine generating station in the District of Ryedale, North Yorkshire (Knapton Generating Station) previously consented on 25 March 1993 by the Department of Trade and Industry, with a Section 36C application (the Variation Application).

The Variation Application seeks to extend the operation of Knapton Generating Station until 31 st December 2035.

Third Energy has received notice under Regulation 4(6) of the Electricity Generating Stations (Variations of Consents) (England and Wales) Regulations 2013 that the Secretary of State considers that the variation application is suitable for publication.

Written or emailed representations should be dated, clearly stating the name (in block capitals), full return email and postal address of those making representations. Only representations sent by email to the address stipulated will receive acknowledgement.

Representations received by the Secretary of State will be handled in compliance with the European Union's General Data Protection Regulation. Any representations received will be shared with the relevant local planning authorities and the applicant with all personal information removed.

The variation application is not EIA Development under the terms of the 2017 EIA Regulations, so these Regulations do not apply. Nevertheless, should the Applicant provide any further environmental information to the Appropriate Authority, the Applicant will publish a notice stating how that information may be inspected and copies obtained, the address that any objections or representations must be sent to and the date (no earlier than 30 days after the last notice is published) by which any such objections or representations must be submitted. The further environmental information will be made available free of charge on the Application website and at the venue listed above.

The application will be determined by the Appropriate Authority in accordance with the Variation Regulations, with note being given to Regulation 8. The Appropriate Authority will consider:

a) Any representations made about the Variation Application to the Appropriate Authority:



i. Which a relevant planning authority makes within two months of the date on which a copy of the Variation Application was served on it under Regulation 5(2)(b) of the Variation Regulations; and



ii. Which any other person makes on or before the date specified in accordance with Regulation 5(5)(b)(iii) of the Variation Regulations, where those representations are not withdrawn; and



b) All other material considerations.



The Secretary of State may consent to vary the 1993 Consent or may refuse consent to vary that consent.
